PLEASE READ THE FOLLOWING TERMS OF SERVICE CAREFULLY
Summary
These terms govern the provision of any computer support services (“Services”) provided by Watchdog Technology, unless overridden by another of our contracts.
Watchdog Technology provides you with use of the Services subject to your compliance with these Terms. Watchdog Technology reserves the right to refuse to provide the Services to anyone at any time without notice for any reason. You represent and warrant to us that you are at least 18 years old; you have the right, capacity and authorization necessary to legally bind yourself to these Terms.
In short:
- We need access to the relevant computer equipment of which you must be the owner.
- Our quotes are non-binding estimates but we’ll make best effort to avoid going over them.
- We may install or remove software and we may need your license keys, if applicable.
- We’ll make a best effort to ensure your data is backed up and safe, but are not responsible in the event of its loss. If you’re concerned that your data is not backed up anywhere else, please let us know immediately and we’ll help you remedy that.
- We won’t disclose your confidential information externally except for services you request or as required by law.
- Unless we offer otherwise, payment is expected at the end of the service call. We’ll walk you through it – all you need is a credit card.
- We’ll do our very best to help you, but computers are very complicated and unforeseen things can happen through no fault of anyone. Sometimes these problems are simply made apparent by diagnosis or fixing an unrelated problem. We can’t be liable for your computer breaking during our work through some rare circumstance. If you let us, we’ll do what we reasonably can to make and keep you a happy customer, though.
Authorization to Access your Computer
You acknowledge that by your use of the Services you are authorizing Watchdog Technology to access and control your computer for the purposes of computer diagnosis, service and repair.
In connection with delivering the Services, Watchdog Technology may download and use software, gather system data, take control of your computer and access or modify your computer settings. By accepting these terms, you hereby grant Watchdog Technology the right to connect to your computer, download, install and use software on your computer to gather system data, repair your computer, take control of your computer and change the settings on your computer while performing the Services.
Quotes
Any verbal or written quote given by Watchdog Technology is given as a guideline based on limited information provided by a customer. A verbal or written quote is intended to give the customer an estimate on the price and not an assurance that the product or service will be sold at that price.
Legal Rights
The client is the legal owner or authorized representative of the legal owner of the property and all data and components contained therein that will receive Services from Watchdog Technology. You must be the owner, or have the permission of the owner, for us to work on your equipment. We will only take instructions for work from the designated owner.
On-site Services
For in-home or in-office Services, you agree to provide full access to computer systems, systems, peripherals or software that are to be serviced and that power, network connectivity and a safe climate controlled work environment is provided along with full co-operation and access to enter your home or business to perform Services. A person of at least 18 years of age must be present during the entire period Services are provided. If no adult is present when our technician arrives, Services will be denied and a cancellation charge equal to one hours work on-site will be assessed.
Software Installation
Watchdog Technology may need to download and or run software on any computers receiving Services to help diagnose and resolve problems. Watchdog Technology may need to reinstall software that was included as part of your computer’s original configuration.
You agree that we may download and utilize software from third party web sites or CDs and accept any applicable license agreements on your behalf. You acknowledge and agree that we may download and install trial versions of Software that will expire and cease to function after a certain period of time (usually 30 days) unless you purchase a license to continue using such Software. We usually avoid this, but it is occasionally necessary.
Backup Services & Potential Data Loss
While Watchdog Technology will make all reasonable efforts to backup and safeguard the contents (data) stored on your computer, you understand and agree that prior to contacting or allowing Watchdog Technology to perform diagnostic, repair, or other Services on your computer, it is your responsibility to backup the data, software, information or other files stored on your computer disks and/or drives if you so desire. You acknowledge and agree that Watchdog Technology and/or its third-party service provider shall not be responsible under any circumstances for any loss, alteration, or corruption of any software, data, or files. If you do not have a backup of your software and data, we can provide you with our data backup service at an additional cost. However, we cannot guarantee the integrity of the data when backing up.
Confidentiality
Watchdog Technology agrees not to disclose any and all information or data files supplied with, stored on, or recovered from client’s equipment except to employees or agents of Watchdog Technology subject to confidentiality agreements or as required by law.
Upgrades
Watchdog Technology can supply manufacturer specific upgrades or spare parts on request. Please note however that we cannot guarantee compatibility with your current system or configuration. Watchdog Technology will offer suggestions and advice on upgrades but is not liable for any compatibility issues.
Payment Terms
Prices for Services are posted on our websites or available as a written quote, for project-type work. Non-binding estimates are available upon request.
All work must be paid in full upon completion of service, unless other terms are offered by Watchdog Technology. If an amount remains delinquent 14 days after its issue date, an additional 5% penalty will be added for each week of delinquency or the maximum permitted by law. In case collection proves necessary, the client agrees to pay all fees incurred by that process.
Limited Liability
Watchdog Technology shall not be liable for any claims regarding the physical functioning of equipment/media or the condition or existence of data on storage media supplied before, during or after service.
In no event will Watchdog Technology be liable for any damage to the laptop/desktop/equipment, loss of data, loss of revenue or profits, or any special, incidental, contingent, or consequential damages, however caused, before, during or after service even if Watchdog Technology has been advised of the possibility of damages or loss to persons or property. Watchdog Technology’s liability of any kind with respect to the Services, including any negligence on its part, shall be limited to the contract price for the Services.
The client and Watchdog Technology agree that the sole and exclusive remedy for unsatisfactory work or data shall be, at Watchdog Technology’s option, additional attempts by Watchdog Technology to recover satisfactory data or refund of the amount paid by the client, unless otherwise offered by Watchdog Technology. This protects us, but in a realistic event, we will be reasonable and do what it takes to ensure you’re happy with our work. The parties acknowledge that the price of Watchdog Technology Services would be much greater if Watchdog Technology undertook more extensive liability.
The client is aware of the inherent risks of injury and property damage involved in laptop/desktop repair, including without limitation, risks due to destruction or damage to the machine, media, or data and inability to repair the machine or recover data, including those that may result from the negligence of Watchdog Technology, and assumes any and all known risks of injury and property damage that may results.
Privacy Policy
Your personal information shall be protected by Watchdog Technology in a manner consistent with the Watchdog Technology Privacy Policy, available by visiting http://www.watchdogtechnology.com/privacy-policy/. By agreeing to these Terms and using our Services, you consent to the collection, use and disclosure of your personal information, as set out in the Watchdog Technology Privacy Policy. Basically, we don’t share anything outside our company unless signing you up to a service at your request or as required by law. Also, we make sure any hardware we dispose of is wiped of personal data.
Laws and Jurisdiction
These Service Terms shall be governed by and construed in accordance with the laws of the State of Minnesota, excluding its conflict of law provisions. The client and Watchdog Technology agree to submit to the exclusive jurisdiction of the courts in Minneapolis, Minnesota. If any provision(s) of the Terms is held by a court of competent jurisdiction to be contrary to law, then such provision(s) shall be construed, as nearly as possible, to reflect the intentions of the parties with the other provisions remaining in full force and effect. The client and Watchdog Technology agree that any cause of action arising out of or related to this Service must commence within one year after the cause of action arose; otherwise, such cause of action is permanently barred.
